Yesterday, Monday, February 6, 2017, our firm filed an amicus brief in support of the President's emergency motion for a stay pending appeal of a
temporary restraining order against the Executive Order regarding immigration and refugees. (Only three briefs were filed in support of the Executive
Order.)
On January 27, 2017, President Trump issued an Executive Order temporarily blocking immigration from seven countries and implementing several other
changes to improve our nation's borders.
Late Friday, the U.S. District Court for the Western District of Washington had issued a Temporary Restraining Order against five provisions of the
Executive Order. Over the weekend, the U.S. Department of Justice filed an emergency motion for an administrative stay (which was denied) and a motion
for stay pending appeal of the TRO with the U.S. Court of Appeals for the Ninth Circuit (which is pending).
Our amicus brief supported the motion for stay pending appeal, urging the Court of Appeals to respect the President's broad power over immigration and
described previous times where various Presidents have exercised this authority, including Presidents Carter, Reagan, and even Obama in 2011.
Furthermore, our brief explained how the TRO threatens our nation's security. There already have been many instances of fraud due to vulnerability in
the refugee program - as admitted by Obama's Department of Homeland Security! President Trump has directed a temporary ban on immigration from seven
specific countries while the administration seeks to build better safeguards into the program.
