The U.S. Supreme Court opens its October 2015
Term today, and our firm is looking ahead to more opportunities and to positively affect cases in which we file amicus curiae briefs.
Already for the upcoming term, we have filed an amicus brief in one merits case,
Luis v. United States which is scheduled to be argued on November 10, 2015.
That case involves whether the government can seize the untainted assets of a federal criminal defendant
before trial, depriving her of the right to retain counsel of her choice.
In the 2014 Term, although we (and the nation) suffered historic losses in the ObamaCare and
same-sex marriage cases, we filed briefs supporting the winning side in important firearms and Fourth Amendment cases.
Here are the merits cases in which we filed amicus briefs in the last term:
Winning side (4):
Henderson v. United States (Firearms)
Our amicus brief
SCOTUS decision
Johnson v. United States (Firearms)
Our amicus brief
SCOTUS decision
Los Angeles v. Patel (Fourth Amendment)
Our amicus brief
SCOTUS decision
Rodriguez v. United States (Fourth Amendment)
Our amicus brief
SCOTUS decision
Losing side (3):
Heien v. North Carolina (Fourth Amendment)
Our amicus brief
SCOTUS decision
King v. Burwell (Obamacare)
Our amicus brief
SCOTUS decision
Obergefell v. Hodges (Same-Sex Marriage)
Our amicus brief
SCOTUS decision
Last term we did not achieve the same level of success as in the 2013 Term, when we were on the winning side in 7 of 10 cases, but we continue to fight. (The wins were McCutcheon, Bond, Rosemond,
Canning, Hobby Lobby, Susan B. Anthony List, and Riley. The losses were Kaley, Abramski,
and Castleman.)
Petition for Certiorari:
In addition to merits briefs, we filed three briefs in support of petitions for certiorari in the following three cases.
(We filed one of only two briefs filed in Luis v. United States, and certiorari was granted in that case.)
Mount Soledad v. Trunk (First Amendment)
Our amicus brief
Rudy v. Lee (Presidential Eligibility — Natural Born Citizen)
Our amicus brief
Luis v. United States (Asset Forfeiture)
Our amicus brief
We count it a privilege to urge the Court to return to the Constitution as it is written in defending our freedoms.
