Attorneys Alicia Kutzer and Bill Olson discuss our two U.S. Supreme Court Amicus briefs, on application for stay and on the merits, in Trump v. Slaughter.  This case involves Separation of Powers and the authority of the President, as chief executive, to appoint and remove federal agency officials.  Our briefs argued that the President’s Article II appointment power inherently includes the power of removal, that Congress exceeded its authority when it approved the FTC Act of 1914, and that the the Supreme Court should overturn their 1935 Humphrey’s Executor decision, under which the administrative state and  bureaucrats wield uncontrollable power.
