Boland v. Bonta — Amicus Brief

Jeremiah Morgan Constitutional Law, Firearms Law, U. S. Court of Appeals, Ninth Circuit

Today, our firm filed an amicus brief in support of a challenge to California’s “Unsafe Handgun Act.” Our brief argued that the Second Amendment’s right to keep and bear arms also protects attendant rights, such as the right to acquire modern, state-of-the-arm firearms. We urged the Ninth Circuit that the Second Amendment does not permit balancing tests such as weighing enumerated rights against claims of public safety. Finally, we reminded the court that the right to self-defense is a God-given right and is not a right that is given or taken away by government.
